What is a Same-Sex Relationship?

Same sex relationships, as opposed to heterosexual relationships, involve two individuals of the same sex. Legally, same sex partnerships are recognised largely the same same way as heterosexual ones. Same sex partners can be common law partners, spouses, and conjugal partners.

Types of Same-Sex Couples

There are several legally recognised types of couples:

Spouses - If the pair is legally married and both partners are at least 18 years old

Common-law partners - If the pair is not legally married, at least 18 years old, and have been living together for at least 12 consecutive months in a conjugal relationship.

Family class - An immigration class which serves to reunite families in Canada.

In order to apply through family class, the Canadian citizen or permanent resident will have to agree to sponsor their partner for the first 3 years of their residency in Canada. The couple will also have to demonstrate that their relationship is genuine and fits under the criteria of common-law or conjugal partners.

Economic class - An immigration class to boost the Canadian economy with skilled workers and business applicants.

In order to settle in Canada through the Economic class, one of the partners applying through the economic class will be able to sponsor their partner to come with them to Canada.

Refugee status - An immigration class to help those fearing persecution in their home countries.

Canada recognizes sexual orientation, gender-based persecution, and HIV+ status as potential grounds for a refugee claim. In order to come to Canada through the refugee stream with a partner, a claimant must file a claim based on a well-founded fear of persecution.

Who Can Be A Sponsor?

You can sponsor your partner for a permanent residence if you:

Are a Canadian Citizen or Permanent Resident.

Have at least 18 years old.

Live in Canada. If you live abroad and plan to return to Canada once your spouse or partner obtains permanent residence this option is also available but only to citizens.

Are willing and able to provide financial support to your spouse or partner for three years.

Who Can Be Sponsored?

You can sponsor your partner for their permanent residence if your relationship falls into one of these categories:

Spouses: If you are legally married.

Common-law Partners: If you have lived together for at least 12 months.

Conjugal Partners: If you have been in a relationship, but there are political, religious, social or, cultural impediments that do not allow you to marry or be considered in a common-law partnership.

What Evidence the Government can Require
