What is a Same-Sex Relationship?

Same sex relationships, as opposed to heterosexual relationships, involve two individuals of the same sex. Legally, same sex partnerships are recognised largely the same same way as heterosexual ones. Same sex partners can be common law partners, spouses, and conjugal partners.

Types of Same-Sex Couples

There are several legally recognised types of couples:

Spouses - If the pair is legally married and both partners are at least 18 years old

Common-law partners - If the pair is not legally married, at least 18 years old, and have been living together for at least 12 consecutive months in a conjugal relationship.

Same-Sex Marriage and Canada’s Immigration Rules

Canada has been recognising same sex marriage since 2005. When it comes to immigration, the rules for spousal and familial sponsorships are largely the same for both same sex and heterosexual couples. The applications take around 12 months to be processed and can be submitted from inside or outside Canada depending on the class and program being applied for.

What is a Same-Sex Spousal Sponsorship?

Several options are available to Canadians wanting to sponsor their same sex partners. For example:

Family class - An immigration class which serves to reunite families in Canada.

In order to apply through family class, the Canadian citizen or permanent resident will have to agree to sponsor their partner for the first 3 years of their residency in Canada. The couple will also have to demonstrate that their relationship is genuine and fits under the criteria of common-law or conjugal partners.

Economic class - An immigration class to boost the Canadian economy with skilled workers and business applicants.

In order to settle in Canada through the Economic class, one of the partners applying through the economic class will be able to sponsor their partner to come with them to Canada.

Refugee status - An immigration class to help those fearing persecution in their home countries.

Canada recognizes sexual orientation, gender-based persecution, and HIV+ status as potential grounds for a refugee claim. In order to come to Canada through the refugee stream with a partner, a claimant must file a claim based on a well-founded fear of persecution.

Who Can Be A Sponsor?

You can sponsor your partner for a permanent residence if you:

Are a Canadian Citizen or Permanent Resident.

Have at least 18 years old.

Live in Canada. If you live abroad and plan to return to Canada once your spouse or partner obtains permanent residence this option is also available but only to citizens.

Are willing and able to provide financial support to your spouse or partner for three years.

Who Can Be Sponsored?

You can sponsor your partner for their permanent residence if your relationship falls into one of these categories:

Spouses: If you are legally married.

Common-law Partners: If you have lived together for at least 12 months.

Conjugal Partners: If you have been in a relationship, but there are political, religious, social or, cultural impediments that do not allow you to marry or be considered in a common-law partnership.

What Evidence the Government can Require

Applying for sponsorship goes much further than meeting the requirements that are mandated by the government of Canada. When applying for sponsorship, couples will be required to submit proof of a genuine and legitimate relationship, regardless of the class through which they are applying.

Couples will likely be asked to submit photographs, documents and other types of evidence to prove the relationship is legitimate. The type of proof that must be submitted will depend on the type of relationship and their current living arrangements. Other documents that can serve as proof are:

Joint bank account statements

Receipts with proof of purchase and payments

Lease contracts

Screenshots of previous conversations

Will the Government Verify the Genuineness of Your Relationship?

The Department of Immigration, Refugees and Citizenship Canada requests evidence to prove your relationship is genuine and not intended solely for the sake of status.

We will guide you through the potential proof you can present to support your case depending on the nature of your relationship to prove it is legitimate and ongoing.

Why Hire Immigration Consultants?

The immigration process can be complex and difficult to navigate. There are many important details to consider when filling out forms and gathering the correct supporting documents. Hiring an immigration professional will ensure the efficacy and accuracy of your application making it a stress free and straightforward process for you.

Subjectivity plays a large part in Canadian spousal sponsorships. Presenting a case with discrepancies, errors or omissions weakens your case and increases the chances of delays or refusals.

An Immigration Consultant is the best option in cases where an application has been previously refused. Previous refusals complicate the process even more and having a professional with years of experience on your side is a huge asset.

In the case of a criminal record or serious medical condition, the application can be even more challenging to navigate. By hiring a professional you will have a comprehensive guide of what to do to maximize your chances of success.

Our team of experts is highly knowledgeable on the spousal sponsorship process. As Licensed Canadian Immigration Consultants, we have successfully filed thousands of applications and we are certain that with our service, you will improve your spouse’s chances of permanent residence.
